GRAFTON – A Wheeling partnership alleges an Ohio-based financial company failed to release a deed of trust.
Brier View Associates Limited Partnership filed a complaint Nov. 7 in Taylor Circuit Court against KeyCorp. citing West Virginia code.
According to the complaint, the plaintiff obtained a loan through defendant's successor KeyBank National Association in October 2001. The suit states the plaintiff refinanced the loan with another lender in September 2017 and contacted the defendant to request that it release the deed of trust.
The plaintiff holds KeyCorp, a successor to KeyBank National Association, responsible because the defendant allegedly failed and refused to provide any response to plaintiff's requests for the release of the deed of trust.
The plaintiff seeks an order directing defendant to execute the release of the deed of trust, award for attorney's fees, costs and interest and all further relief as the court deems appropriate. It is represented by Ronald M. Musser of Spilman Thomas & Battle PLLC in Wheeling.
