Electrical products supplier alleges contractor owes $13,000

KEYSER — A Martinsburg electrical products supplier is suing a contractor, alleging it owes more than $13,000 for breach of agreement and unjust enrichment.

Capital Lighting & Supply LLC, doing business as CapitalTristate, filed a complaint in Mineral Circuit Court against Mountain State Electric LLC, alleging failure to perform its obligations under the terms of an agreement.

According to the complaint, CapitalTristate sold materials and supplies to Mountain State Electric on credit. As of July 5, the suit says, the principal amount of $13,038.90 plus a service charge of $668.72 remains due and owing. The plaintiff alleges Mountain State Electric has failed and refused to make payments in full or any part thereof.

CapitalTristate seeks trial by jury, judgment of $13,038.90, plus interest and all other just and appropriate relief. It is represented by attorney Mary K. Prim of Scott Depot.
