Local resident sues mortgage loan servicer for misrepresentations

HUNTINGTON — A mortgage loan company faces accusations of "illegal and abusive loan servicing" in a recent lawsuit.

Malinda Gibson filed a complaint in Cabell Circuit Court against Seterus Inc., alleging the mortgage loan servicer failed to apprise her of her rights to contest a denial of loss mitigation assistance.

According to the complaint, Gibson contacted Seterus to apply for loss mitigation options. After applying, Gibson claims the company unnecessarily delayed implementing the program. The servicer ultimately denied her application, but did not give her a reason, the complaint states. The company is now pursuing a wrongful foreclosure, she says.

The plaintiff requests a trial by jury and seeks actual and punitive damages, attorney's fees and costs. She is represented by Lorre Stark and Bren Pomponio of Mountain State Justice Inc. in Charleston.
