Wyoming Co. man says PSD's negligence led to cancer

PINEVILLE — A Wyoming County customer has filed a class action lawsuit against water suppliers, alleging negligence led to the plaintiff developing cancer.

Rodney Kirkendoll, individually and on behalf of all others similarly situated, filed a complaint in Wyoming Circuit Court against Kopperston Public Service District and John Doe Inc., alleging the water suppliers breached their duty to provide water safe for human consumption.

According to the complaint, as a result of his exposure to illness-causing pollutants in the defendants' water supply, Kirkendoll was diagnosed with and is being treated for cancer. The suit says other customers were placed at an increased risk of developing kidney and liver disease, organ failure and cancer. 

The plaintiff alleges Kopperston Public Service District and John Doe negligently permitted illness-causing pollutants to contaminate their water supply.

Kirkendoll seeks trial by jury, all damages, attorney fees, court costs and all other proper and just relief. He is represented by attorneys Adam D. Taylor in Beckley, and by Stephen P. New of The Law Office of Stephen P. New in Beckley.
