BECKLEY – A Beckley woman says she was injured when she tripped over a parking bumper at a recovery center.
Andrea Bella filed her lawsuit in Raleigh Circuit Court against Southern West Virginia Fellowship Home Inc., doing business as Beckley Recovery Community Center.
According to her complaint, Bella was a licensee on the property Aug. 5, 2019, when she was walking down a handicap ramp. At the bottom of the ramp, Bella says she tripped and fell over an asphalt bump that was the same color as the parking lot.
“The asphalt parking bumper was raised and was directly adjacent to the bottom of the handicap ramp, thus blending in with the main parking lot,” the complaint states. “Plaintiff, not seeing the raised parking bumper, tripped, fell and suffered a fractured right femur among other injuries.”
She blames the defendant’s negligence for her injuries.
Bella seeks compensatory damages for physical pain and suffering, mental anguish and suffering, permanent physical impairment, loss of capacity to enjoy life, medical expenses, annoyance, aggravation, inconvenience and other relief. She also seek punitive damages, pre- and post-judgment interest, attorney fees, court costs and other relief.
She is being represented by Kirk Lightner of New Taylor & Associates of Beckley. The case has been assigned to Circuit Judge Andrew Dimlich.
