Man sues Chase Bank for breach of contract

CHARLESTON — A man is suing JPMorgan Chase for breach of contract when he alleges it failed to timely credit his account when fraud occurred.

Jeremy Foster had an account with JPMorgan Chase Holdings and his card information was improperly accessed and used without his knowledge, according to a complaint filed in Kanawha Circuit Court

Foster claims when he became aware of the criminal activity with his card, he contacted Chase and provided the information regarding the fraud, as well as contacting the manager of the store where the charges were incurred and the Kanawha County Sheriff's Office.

Chase temporarily credited Foster while it investigated the incident and later reversed the credit, causing Foster to lose $1,000.85 of his hard-earned money, the complaint states.

Foster claims Chase held his funds hostage for months before finally crediting his account, causing him to suffer an out-of-pocket loss. He claims Chase failed to protest him and failed to timely credit his account.

Foster is seeking compensatory damages. He is represented by Troy N. Giatras and Matthew Stonestreet of The GIatras Law Firm in Charleston.

The case is assigned to Circuit Judge Tera Salango.
