WHEELING — An Ohio County couple is suing Optum Pharmacy alleging a deviation from the standard of care that caused an eye infection.

Dr. Harold F. Leeper and his medical practice; Avella of Deer Valley, which is known as Optum Pharmacy 801 Inc.; and Genentech Inc. were also named as defendants in the suit

John Mackey and his wife, Dianna Mackey filed the lawsuit against the defendants alleging a deviation from the standard of care, according to a complaint filed in Ohio Circuit Court.

John Mackey saw Leeper on March 21, 2019, and Leeper injected Avastin into his left eye, but did so with either a faulty injection technique that caused bacteria to be introduced to his eye, or the sample of Avastin was contaminated or both. John Mackey sustained permanent eye damage from the infection.

Avella provided the Avastin to Leeper, according to the suit.

The Mackeys are seeking compensatory damages. They are represented by Frank X. Duff and Sandra Law of Schader Companion Duff & Law in Wheeling.

Ohio Circuit Court case number: 21-C-27
