Man says State Farm failed to respond to a request by his attorney

FAYETTEVILLE — An Oak Hill man filed a lawsuit against State Farm Mutual Insurance Company alleging that it failed to respond to a request from his counsel regarding a lawsuit.

A car accident occurred June 11, 2020, and Mark Thompson's counsel sent a letter on July 28 to Stae Farm regarding the crash that occurred between Thompson and Garland R. Parker Jr., according to a complaint filed in Fayette Circuit Court.

Thompson claims his attorney's letter requested the declarations page of the liability policy and provided all the required information and met West Virginia code.

The defendant failed to respond to the request within 30 days after the receipt of the written request and failed to comply with West Virginia code, according to the suit.

Thompson claims the defendant is subject to penalties for failing to comply with West Virginia code and is also subject to the fees and expenses incurred from the filing of the lawsuit.

Thompson is seeking judgment and statutory penalties. He is represented by Kevin B. Burgess and Jordan L. Adkins of Hamilton Burgess Young and Pollard.
