Woman says Dollar General responsible for injuries

CHARLESTON — A Kanawha County woman is suing Dollar General for injuries sustained when she fell while shopping in the South Charleston location.

Rebecca Jane Cousins was in the store on May 11, 2020, when she fell and injured her right arm, according to a complaint filed in Kanawha Circuit Court.

Cousins claims she incurred permanent mental and physical injuries because of the fall and that Dollar General had a duty to reasonably design and inspect, repair and maintain its premises so that there were n unsafe conditions.

"Defendant breached said duty by failing to design, inspect, repair, and maintain the surface of the floor on which Plaintiff was shopping to prevent falls," the complaint states.

Cousins claims she suffered a loss of enjoyment of life and annoyance, inconvenience and embarrassment.

Cousins is seeking compensatory damages. She is represented by Michael J. Del Giudice of Ciccarello, Del Giudice and LaFon in Charleston.
