Woman says Oak Hill responsible for property flooding

FAYETTEVILLE — A woman is suing the city of Oak Hill for flooding on her property that has caused her damages and injuries.

Brenda Duncan's home has experienced flooding and continues to experience flooding in and around her property on Oyler Avenue due to the defendant's faulty drain lines, according to a complaint filed in Fayette Circuit Court.

Duncan claims she has suffered damage to her home and has been physically ill, subjected to insect bites and otherwise harmed because of the flooding on her property.

"The acts of the Defendant constitute negligence and/or breach of parties' contract and/or breach of the Defendant's obligations as a public service district," the complaint states.

The plaintiff is seeking judgment against the defendant for injuries to herself and her property. She is represented by Anthony M. Salvatore of Hewitt & Salvatore in Fayetteville.
