Man sues nursing home for wife's injuries, death

HUNTINGTON — A man is suing a senior center for negligence during his wife's admission.

Paramount Senior Living at Ona; Paramount Health Resources; Paramount Health Holdings Group; Adam Hemdon; and ten unidentified entities were all named as defendants in the suit.

Gilbert Plants, as the administrator of the estate of Maggie Lou Plants, claims the defendants were in charge of his wife's health from Nov. 18, 2021, until Dec. 25, 2021, according to a complaint filed in Cabell Circuit Court.

Gilbert Plants claims Maggie Plants died on April 2, 2022, while at Holzer Medical Center.

The defendants were well aware of Maggie Plants' medical condition and the care she required and they represented that they could adequately care for her, according to the suit.

Gilbert Plants claims his wife suffered unexplained injuries, a fall on Dec. 25, 2021, that resulted in a hip fracture and surgery and, eventually, her death.

Maggie Plants' injuries were continuing in nature and occurred throughout her residency, according to the suit.

Gilbert Plants claims the defendants were aware of systemic problems at the senior center.

"The Defendants are directly liable for the acts and/or omissions contained herein due to the direct control, ownership, and/or management of the operations of Paramount Senior Living at Cabell Midland," the complaint states. "This exertion of control, ownership, and/or management by the Defendants created a dangerous environment for all residents..."

Gilbert Plants claims the defendants were aware of the dangerous environment that was created by their methods of management and were liable for the actions alleged within the complaint.

Gilbert Plants claims the defendants were negligent and caused his wife's death.

Gilbert Plants is seeking compensatory and punitive damages. He is represented by James B. McHugh, Michael J. Fuller Jr., D. Bryant Chaffin and John R. Cumming of McHugh Fuller Law Groip in Hattiesburg, Miss.

The case is assigned to Circuit Judge Gregory L. Howard Jr.
