Woman alleges she was injured by car crash caused by Masontown employee

KINGWOOD — A woman is suing Masontown alleging she was injured in a car accident caused by a town employee in a town-owned vehicle.

Sarah Sidebottom was stopped at a stop sign on July 8, 2022, in the northbound lane of travel of East Depot Way, according to a complaint filed in Preston Circuit Court.

Sidebottom claims Daniel Allen Luzier was operating a town-owned vehicle and was traveling west on North Main Street when he turned onto the southbound lane of East Depot Way.

When turning, Luizer failed to maintain control of the vehicle, failed to keep in the proper lane and struck Sidebottom's vehicle, causing her to suffer catastrophic, severe and permanent injuries, according to the suit.

Sidebottom claims since Luzier was a Masontown employee and/or agent and the defendant entrusted the vehicle to him, it owed a duty to her for Luzier to operate the vehicle in a safe, prudent and reasonable manner.

"Defendant Town of Masontown's employee/agent, for whose conduct the Defendant is liable, breached these duties of care owed to Plaintiff by negligently failing to maintain control of its vehicle and failing to keep its vehicle in the proper lane," the complaint states.

As a result of the defendants' actions, inactions and/or breach of duties of care, the plaintiff suffered personal injuries and related damages for which she is seeking recovery, according to the suit.

Sidebottom claims she sustained physical and emotional injuries as a result of the crash and required medical treatment in the past and will continue to need treatment in the future.

"Moreover, Plaintiff has incurred lost wages and other economic and non-economic damages as a direct and proximate result of the Defendant's negligence which caused the subject crash," the complaint states.

Sidebottom is seeking compensatory damages with pre- and post-judgment interest. She is represented by Benjamin D. Adams and Mark E. Troy of Morgan & Morgan in Charleston.

The case is assigned to Circuit Judge Steven Shaffer.
