Former employee says hospital wrongfully terminated employment

CHARLESTON — A former employee says Pocahontas Memorial Hospital wrongfully terminated her employment and caused her damages.

Alicia Hanshew was employed with the defendant and was under contract for minimum guaranteed hours, according to a complaint filed in Kanawha Circuit Court.

On at least one occasion, Hanshew claims she was denied hours and sought unemployment for lost wages.

Hanshew claims she had to take her complaints before an administrative law master or judge when PMH fought her lost wages complaint and the judge ruled in favor of Hanshew to receive her minimum hours.

The plaintiff was returned to her guaranteed hours after the judge ruled in her favor, however, in February, she was denied her guaranteed hours again and discriminated against for reporting major concerns with patient care that were an ongoing problem, according to the suit.

Hanshew claims the defendants breached their contract and violated the state's wage payment laws. She claims the defendant also retaliated against her for making complaints about safety violations and violated public policy.

Hanshew is seeking compensatory and punitive damages. She is represented by D. Adrian Hoosier II if Hoosier Law Firm in Charleston.
