Woman sues car dealership for vehicle in bad condition

CHARLESTON — A woman is suing WV Preowned Auto for a vehicle she purchased that was not in good condition when she purchased it.

Brandon Ferrari and Gary Newhouse, owner and employee of WV Preowned Auto; Tomahawks Garage and its manager, Jeremy Garrett, were also named as defendants in the suit.

Sue Savage purchased an automobile from WV Preowned Auto in March 2022 and at the time of the purchase, the automobile had not been inspected, so an employee of the dealership accompanied Savage to Tomahawks to get it inspected, according to a complaint filed in Kanawha Circuit Court.

Savage claims the employee for Tomahawks approached the vehicle in the parking lot and did nothing more than place a sticker on the vehicle, without an inspection.

After driving the vehicle for a short time, Savage noticed that it swayed and she took it to another place for an inspection, where she discovered the vehicle had a rear subframe that was severely rusted, according to the suit.

The defendants knew or should have known the vehicle was in a dangerous condition, according to the suit.

Savage is seeking compensatory damages with pre- and post-judgment interest. She is represented by Jeff C. Woods of The Law Office of Jeff C. Woods in Hurricane.

The case is assigned to Circuit Judge Carrie Webster.
