Man sues CAMC for father's injuries

CHARLESTON — A man is suing Charleston Area Medical Center for injuries his late father sustained during his time at the hospital.

James Duncan was a patient of the defendant several times in June and August of 2022 and during his stays he suffered a left heel unstageable pressure injury, according to a complaint filed in Kanawha Circuit Court.

Curtis Duncan claims the defendant's negligence caused his father to suffer the pressure injury to his left heel and then the worsening of the pressure wounds.

"That as a direct and proximate result of the negligence of Defendant Charleston Area Medical Center, by and through its agents and employees, Plaintiff suffered an unstageable pressure injury of the left heel, as well as worsening of subsequent pressure wounds, until his death on or about September 3, 2022," the complaint states.

James Duncan sustained bodily injuries resulting in pain and suffering, mental anguish, inconvenience, physical impairment, loss of capacity for the enjoyment of life, aggravation of existing diseases and physical defects and he incurred medical expenses.

Curtis Duncan is seeking compensatory and punitive damages. He is represented by Jeff D. Stewart, Andrew L. Paternostro, Katherine H. Arritt and Allison R. Santer of Stewart Bell in Charleston.

The case is assigned to Circuit Judge Tera Salango.
