Sherrie O'Brien sues JPMorgan Chase Bank for violations of West Virginia Consumer Credit and Protection Act and West Virginia Computer Crimes and Abuse Act

In the United States District Court for the Southern District of West Virginia, Sherrie O'Brien has filed a lawsuit against JPMorgan Chase Bank, N.A. The case number is 2:24-cv-173 and it was filed on April 4, 2024. The plaintiff alleges that the defendant violated the West Virginia Consumer Credit and Protection Act (WVCCPA) and the West Virginia Computer Crimes and Abuse Act.

O'Brien, a resident of Kanawha County, claims that after falling into arrears with her account at JPMorgan Chase Bank, she began receiving collection calls from the bank. She hired a lawyer to represent her interests in connection with this debt. Despite informing the bank about her legal representation and requesting them to stop calling her, O'Brien alleges that the bank continued to place calls to her residential number.

The plaintiff accuses JPMorgan Chase Bank of engaging in unreasonable or oppressive conduct by placing repeated phone calls even after being asked to stop. She also claims that they failed to clearly disclose their business entity when making demands for money. These actions, according to O'Brien, have caused her distress and indignation.

O'Brien is seeking judgment for violations of Article 2 of WVCCPA and the West Virginia Computer Crimes and Abuse Act. She seeks remedies set forth in Article 5 of WVCCPA due to the alleged harassment by JPMorgan Chase Bank.
