Motorist's lawsuit blames truck driver for injuries

CHARLESTON – A Kanawha County woman is suing a truck driver and his employer, claiming they are responsible for a wreck in which she was injured.

Christina Martin filed a lawsuit Feb. 25 in Kanawha Circuit Court against Milton Moody and Douglas & Sons Inc., alleging negligence and vicarious liability.

According to the complaint, Martin was operating her 2001 Chevrolet Cavalier on April 25, 2014 while traveling east on Interstate 64 in Charleston. The suit says Moody, operating a Peterbilt TK tractor-trailer truck owned by Douglas & Sons, carelessly switched lanes in front of Moody, striking her vehicle. Moody claims she suffered injuries and vehicle damage, incurred ongoing medical expenses, and was left with permanent impairment and diminished capacity to enjoy life.

Martin seeks a jury trial, punitive and compensatory damages, interest, and reimbursement for litigation costs. She is represented by attorneys Robert D. Cline Jr., Robert A. Campbell, Letisha R. Bika and George Chamberlain of Farmer, Cline & Campbell PLLC in Charleston.

Judge Jennifer F. Bailey is assigned to the case.
