Man says insurance providers breached contract

BECKLEY — A homeowner is suing Erie Insurance Property & Casualty and Pat Reed Insurance Inc., insurance providers, citing alleged breach of contract and negligent misrepresentation.

William Pritchett filed a complaint on July 7 in Raleigh Circuit Court against the defendants, alleging that they violated the Unfair Trade Practices Act of West Virginia.

According to the complaint, the plaintiff alleges that he experienced property loss in early February 2015, and that his home was damaged while he waited five months for a insurance decision, because he could not afford to pay the repairs. As a result, he has suffered aggravation, emotional distress, mental anguish and economic loss, he claims. The plaintiff holds the defendants responsible over allegations that they wrongfully denied and mishandled his claim, failed to make a decision until five months later and failed to pay the amount due under the contract.

The plaintiff requests a trial by jury and seeks enforcement of the contract, judgment against defendants for all damages, attorney fees, costs, pre- and post-judgment interest and all other applicable relief.
