Well operator blamed for water runoff damages

LOGAN — A real estate owner is suing Cabot Oil & Gas Corporation, a well operator, citing alleged negligence and insufficient measures taken to prevent property damages.

Greg Blevins filed a complaint on Aug. 10 in Logan Circuit Court against Cabot Oil & Gas Corporation, alleging that the well operator negligently acted in grading and sloping a pad site.

According to the complaint, the plaintiff alleges that the downhill slope has enabled a quantity of water to run off in whatever path the water determines, which caused damage to his property. The defendant's negligence caused plaintiff to suffer diminution in property value, annoyance and inconvenience, the suit alleges. The plaintiff holds Cabot Oil & Gas Corporation responsible because the defendant allegedly negligently graded roadways and a pad site on the hillside of his property, and graded the pad site on a downhill slope rather than toward the ditch.

The plaintiff requests a trial by jury and seeks judgment against the defendant for actual damages for the diminished value of his property, for annoyance and inconvenience suffered by the plaintiff, and for intentional acts of trespass.
