CHARLESTON — A Kanawha County woman is suing the county board of education, alleging its negligence led to injuries for the plaintiff.
Anita McGrew filed a lawsuit Nov. 1 in Kanawha Circuit Court against the Kanawha County Board of Education, alleging agency breached its duty to keep its premises free of preventable tripping hazards.
According to the complaint, on Jan. 15, 2015, McGrew was walking down the hallway of Capital High School in a normal manner when she was tripped by the base of a retractable metal gate. The suit says the fall caused her to sustain serious injuries to her arms and body.
As a result, the lawsuit states, McGrew was hospitalized and remained a patient until Jan. 20, 2015, and was admitted to a nursing facility until Feb. 7, 2015. The plaintiff alleges the board of education failed to maintain the hallway in a reasonably safe condition, failed to keep it free from tripping hazards and failed to provide adequate warnings.
McGrew seeks trial by jury, compensatory damages, with pre- and post-judgment interest, attorneys' fees and costs and such other and further relief. She is represented by attorneys Tony L. O'Dell, Cheryl A. Fisher and Andrea Nease Markins of Tiano O'Dell PLLC in Charleston.
