J&E Trucking, driver named in suit after state Route 73 collision

LOGAN – A woman alleges she and her infant daughter were injured in a rear-end collision on state Route 73 in Logan.

Krystal D. Beckett, individually and as next friend of Nyla Harvey, an infant filed a complaint Oct. 6 in Logan Circuit Court against J&E Trucking Inc. and Daniel Kelley alleging that the commercial vehicle owner and operator defendant J&E negligently entrusted its commercial vehicle to a careless driver.

According to the complaint, the plaintiff alleges that on Feb. 17, she and her minor child were passengers in a motor vehicle and stopped at a traffic light when defendant Kelley negligently drove the commercial vehicle owned by defendant J&E and caused it to crash into the rear of the plaintiffs' vehicle. As a result of the impact, they allege they sustained serious injuries resulting in pain and suffering, mental anguish, loss of enjoyment of life and medical expenses. 

The plaintiff holds J&E Trucking Inc. and Kelley responsible because defendant Kelley allegedly operated the said vehicle in a reckless and negligent manner by failing to stop at the red light traffic signal.

The plaintiff requests a trial by jury and seeks compensatory damages, pre- and post-judgment interest, attorney fees and costs and such other and further relief. She is represented by Paul A. Ryker of Paul A. Ryker Attorney at Law in Barboursville. The case has been assigned to Circuit Judge Eric H. O'Briant.
