Woman sues Chrysler Capital for repossession

WINFIELD — A woman is suing Chrysler Capital alleging that it repossessed her vehicle without first sending her notice to cure her defaulted account.

Santander Consumer USA Inc. is doing business as Chrysler Capital.

Tiffani D. Rowe purchased a 2018 Jeep Compass in January 2019 from Dutch Miller South Charleston and financed the purchase through Chrysler Capital, according to a complaint filed in Putnam Circuit Court.

Rowe claims she fell behind on payments in September 2019, but she was up to date by Nov. 14, 2019. Due to the COVID-19 pandemic, she fell behind on payments again in July 2020 and the defendant repossessed the car on July 22, 2020. She claims she did not receive a Notice of Right to Cure Default before they repossessed the vehicle. 

Despite the lack of receiving another NRCD, the plaintiff contacted the defendant and attempted to resolve the default by bringing the account current, however, the defendant would not accept the payments and instead called for her to pay the entire amount owed, which she could not do, according to the suit.

Rowe claims she also attempted to recover her personal belongings from the vehicle, but the defendant refused to return them.

Rowe is seeking compensatory damages. She is represented by Brian R. Blickenstaff of Turner & Johns in Charleston.
