Woman sues facility for family member's injuries, death

CHARLESTON — A woman is suing Cedar Ridge Center for her family member's injuries and death.

Genesis Healthcare was also named as a defendant in the suit.

Teddy Joe Martin was a resident at Cedar Ridge Center and fell at least five times during his time at the facility, the last fall occurring on Sept. 25, 2022, according to a complaint filed in Kanawha Circuit Court.

On Oct. 4, 2022, Martin was taken to Charleston Area Medical Center for evaluation and it was determined that the last fall fractured his left hip.

Robin Moss claims the standard of care requires that the facility identify each resident at risk for accidents and/or falls and adequately plan care and implements procedures to prevent accidents.

"The facility did not implement appropriate procedures to prevent Mr. Martin from falling multiple times," the complaint states. "The failure to implement procedures to prevent falls resulted in a breach in the standard of care for the prevention of accidents. The numerous falls Mr. Martin sustained caused a decline in activities of daily living."

Moss claims as a result of the defendants' negligence, Martin suffered physical and mental pain and suffering, severe emotional distress and incurred medical expenses.

The defendants failed to timely send Martin for evaluation and treatment of his broken hip, according to the suit.

Moss claims the defendants were willful, wanton and in reckless disregard for Martin's well-being and health.

Moss is seeking compensatory and punitive damages. She is represented by Charles M. Love IV of The Love Law Firm in Charleston.

The case is assigned to Circuit Judge Joanna Tabit.
