Man says storage company destroyed his business records

CHARLESTON – A Kanawha County man says a company destroyed business records he had stored with them.

Edward G. Atkins of Charleston filed his complaint in Kanawha Circuit Court against Iron Mountain Incorporated.

According to the complaint, Atkins entered into a contract with Iron Mountain around May 2014 for the storage of his business records, including client files. However, on or about August 17, 2017, Atkins alleges his business records were destroyed by Iron Mountain without his knowledge or consent. Despite this alleged destruction, Iron Mountain continued to bill Atkins for storage fees through August 11, 2023.

Atkins claims he learned of the destruction of his business records on August 16, 2023 and was informed by Tracy Ward, an agent or employee of Iron Mountain. From August 22, 2017, through August 11, 2023, Atkins paid $14,954.25 for storage fees for his destroyed business records.

Atkins is seeking compensatory damages as well pre- and post-judgment interests an court costs.

He is being represented by J.B. Akers of Akers Law Offices in Charleston. The case has been assigned to Circuit Judge Kenneth Ballard.
