PINEVILLE – A Virginia man is seeking damages after he was electrocuted while working in a Kimball mine.
David J. Mitchell and Tamara Mitchell filed a complaint Jan. 9 in Wyoming Circuit Court against Nufac Mining Co. Inc. alleging negligence and loss of consortium.
According to the complaint, on Aug. 14, 2017, David J. Mitchell was employed by Legacy Land Management and working at defendant's underground coal mine in Kimball. The suit states David J. Mitchell was attempting to rehang a power supply cable that unbeknownst to him was not properly insulated, causing him to receive an electrical shock. He alleges he sustained serious burns to his left hand as well as electrocution brain injury, resulting in neurological sequelae.
The plaintiffs hold Nufac Mining Co. Inc. responsible because the defendant allegedly negligently permitted David J. Mitchell to work in an area where he would be exposed to dangerous and unsafe conditions.
The plaintiffs request a trial by jury and seek judgment against the defendant in an amount that will be determined by jury, costs and attorney's fees and pre- and post-judgment interest. They are represented by D. Blake Carter Jr. of Bailey Javins & Carter LC in Charleston. The case has been assigned to Circuit Judge Warren R. McGraw.
