MOUNDSVILLE — A couple is suing a contractor for failing to complete their home and breaching their contract.

Scott Martin Construction, Scott Martin Jr., Bayer Heritage Federal Credit Union, Fritz Heating and Cooling, Roger McQuain and John Doe Masonry/Foundation Contractor were all named as defendants in the suit.

Domenic Ellis and Shelby Ellis contracted with Scott Martin Construction on Sept. 23, 2018, for the construction of a home and financed the home through Bayer Heritage Federal Credit Union, according to a complaint filed in Marshall Circuit Court.

The Ellises claim the home was to be completed by June 1, 2019, but it was not finished and the Ellises were forced to move into an unfinished home in September 2019. The house has still not been fully completed.

The Ellises claim the defendants breached their contract and were negligent. They claim the defendants were unjustly enriched at their expense.

The Ellises are seeking compensatory damages. They are represented by Bruce M. Clark of The Bruce Clark Law Firm in Mt. Pleasant, Ohio.

The case is assigned to Circuit Judge David Hummel.
