CHARLESTON — S&S Engineers is suing JustTech alleging breach of contract for failure to uphold its agreement.
On Jan. 1, 2019, S&S contracted with JustTech to manage network services and on April 15, 2021, S&S entered into another agreement with JustTech to connect computers located at newly acquired office locations, according to a complaint initially filed in Kanawha Circuit Court and removed to U.S. District Court for the Southern District of West Virginia.
S&S claims JustTech provided an offsite backup service on a daily basis during the course of the agreement and on June 4, 2021, JustTech informed S&S that the integration of data from one of the newly acquired offices would occur on June 7 and 8, 2021.
During those two days, S&S's operations were shut down to facilitate the integration of the data to the server, however, on June 9, 2021, Sean Vititoe, an employee of JustTech, informed S&S the integration process was taking longer than expected, according to the suit.
S&S claims on June 16, 2021, it was informed against the integration would occur on June 17 and 18, 2021, but the data was not integrated and the last successful backup of S&S's server was on June 24, 2021.
On July 2, 2021, JustTech was subjected to a malware/ransomware attack that comprised S&S's server, as well as its computers, workstations and laptops, according to the suit.
S&S claims JustTech failed to integrate the data from the newly acquired location and because of its actions and/or omissions, S&S was completely shut down for 2.5 weeks and unable to conduct business at full capacity for a period of time.
The defendant breached its contract with S&S, according to the suit.
S&S is seeking compensatory damages. It is represented by Ramonda C. Marlin and Andrew W. Holbrook of Lewis Glasser in Charleston.
A scheduling order was filed in the case, planning a settlement meeting for no later than May 24, 2023, a pretrial conference on June 22, 2023, and a trial scheduled foe July 11, 2023.
