Woman says T-Mobile didn't pay her the same as male counterparts

CHARLESTON – A Kanawha County woman claims T-Mobile didn't pay her the same as her male counterparts.

Donna Anderson filed her complaint in federal court against T-Mobile USA, Inc.

According to the complaint, Anderson started working for T-Mobile in February 2016 as a paralegal and later became a senior paralegal. She claims she was paid under the LO9 Pay Band at a rate of $40 per hour. But, she says two male colleagues who were senior contract negotiation managers performed similar job functions and were paid under the LO8 Pay Band at a higher rate.

Anderson says she spoke with management in July 2021 about the pay disparity and received assurances it would be corrected by Thanksgiving of that year. Then, she was told it would happen by February 2022, and then again that it would happen by Spring 2022. But she says she continued to be paid less than her male counterparts.

In May 2022, Anderson says she was constructively discharged by T-Mobile because of her gender and for raising concerns about the pay issue. After that, her job was posted as a senior contract negotiation manager under the higher LO8 Pay Band.

Anderson accuses T-Mobile of violating the Equal Pay Act, the West Virginia Wage Payment and Collection Act and the West Virginia Human Rights Act.

She seeks compensatory damages, lost wages, lost benefits, back pay, front pay, liquidated damages and damages for indignity, embarrassment, humiliation, annoyance and inconvenience as well as punitive damages, pre-judgment interest, court costs, attorney fees and other relief.

Anderson is being represented by Mark Atkinson and John-Mark Atkinson of Atkinson & Frampton in Charleston.
