Mine fatality results in lawsuit

PINEVILLE -- A West Virginia woman is suing after her husband was killed on the job in an underground mine.

Shera Lee Ann Bryant, individually, as parent, guardian, and next friend of Johnny Mack Bryant III, and Mackenzie Lynn Bryant, and as administrator of the estate of Johnny Mack Bryant II, deceased, filed a lawsuit March 17 in Wyoming Circuit Court against Coal River Mining LLC, Coal River Energy LLC, James O. Bunn II and Joy Technologies Inc., doing business as Joy Mining Machinery, citing negligence and strict liability.

According to the complaint, on July 27, 2012, Johnny Mack Bryant II was employed as an underground coal miner by CRM when his supervisor started a continuous mining machine while Bryant was in the immediate vicinity, crushing Bryant and causing his death. According to the lawsuit, Bunn was in charge of mining safety services for CRM and Joy Mining Machinery designed and distributed the machine involved in the tragedy.

Shera Lee Ann Bryant is seeking compensatory and punitive damages.

She is being represented in the case by attorney Mark H. Mitchell.
