LOGAN—A Cabell County couple is suing a Logan County hospital, alleging liability in an fall on a slippery floor.
LaHoma and Charles Caserta of Barboursville filed a lawsuit May 7 against Logan General Hospital, doing business as Logan Regional Medical Center, in Logan Circuit Court, alleging negligence in a 2014 accident.
According to the complaint, Logan General allowed a dangerous condition to exist in its facility June 20, 2014, by failing to keep its interior flooring, hallways and/or walkways safe. The suit states LaHoma Caserta slipped and fell on a wet slippery substance while attempting to board an elevator.
The plaintiffs allege personal injuries including a shattered elbow requiring surgery. The suit alleges the defendant used a cleaning machine with a history of leaking water and/or cleaning solution prior to the incident.
The lawsuit alleges breach of duty of ordinary care, failure to address and correct a dangerous condition, and failure to warn the plaintiff of the hazard.
The suit says the plaintiffs sustained: pain and suffering; loss of wages, enjoyment of life, consortium and ability to perform household services; humiliation, embarrassment and inconvenience.
The Casertas seeks compensatory damages, pre- and post-judgment interest, attorney fees, and costs. The couple is represented by attorney Truman Griffith of Warner Law Offices in Charleston. The case has been assigned to Circuit Judge Eric H. O'Briant .
