Daughter alleges nursing home neglect in mother’s treatment

PINEVILLE—A Wyoming County woman is suing a Kanawha County-based long-term care facility, alleging negligence in her mother’s care that she says led to medical complications.

Lana Dunn filed a lawsuit as power of attorney for Betty Harrison June 9 in Wyoming Circuit Court against Wyoming Nursing & Rehabilitation Center, doing business as Wyoming Nursing & Rehabilitation Center, and Wisteria, both of Charleston, alleging professional malpractice.

According to the complaint, starting Sept. 27, 2007, Harrison was a resident, and the facility failed to provide basic needs such as food, liquid, toileting and cleaning. The suit says Harrison suffered a bowel obstruction and other issues resulting in pain, anguish and medical expenses.

The complaint states the defendants were in breach of duty by providing substandard care to its residents, including Harrison. The suit alleges failure to allow the patient the right to participate in planning her overall care, to be free of abuse, neglect, or restraint and to be adequately informed about her condition and treatment.

The plaintiff cites statutory violations, negligence and reckless misconduct.

Dunn seeks compensatory and punitive damages, attorney fees and costs. She is represented by attorneys Andrew Paternostro and Jeff Stewart of The Bell Law Firm in Charleston. The case has been assigned to Circuit Judge Warren Randolph McGraw.
