Mother sues IHOP for her son's injuries

CHARLESTON – A minor, through his mother, is suing International House of Pancakes for injuries sustained at the restaurant.

Country Road 3054 Inc. is doing business as International House of Pancakes.

On May 27, 2013, J.T. was walking into IHOP in South Charleston to dune with his mother, Seema Triplett, according to a complaint filed in Kanawha Circuit Court.

The plaintiffs claim as J.T. entered the restaurant, he tripped on an unsecured rug/floor mat and fell forward into a bench.

The action of striking his forehead on the bench caused a large laceration that immediately began to bleed, requiring medical and surgical treatment, according to the suit.

The plaintiffs claim prior to the plaintiff's fall, the defendant knew, or should have known, about the hazardous and dangerous condition created by the unsecured rug/floor mat in the entrance of the restaurant.

The defendant failed to take any type of corrective action concerning the unsecured rug/floor mat and did not take any action to warn its customers to maintain the defendant's premises in a reasonably safe condition, according to the suit.

The plaintiffs claim the defendant was negligent and caused J.T. severe injuries.

J.T. and Triplett are seeking compensatory and punitive damages with pre- and post-judgment interest. They are being represented by Shawn R. Romano and Romano & Associates PLLC.

The case is assigned to Circuit Judge Louis Bloom.
