CHARLESTON - A former employee is suing the Shape Shop Inc. after she claims it discriminated against her after she was injured at work.
Sherry Cochran-Jurin was employed by the defendant from May 2012 until Oct. 15, 2012, according to a complaint filed Nov. 18 in Kanawha Circuit Court.
Cochran-Jurin claims during the course of her employment she consistently performed her duties in a satisfactory manner and met the reasonable expectations of the defendant and was not administered any written warnings.
On Oct. 15, 2012, Cochran-Jurin was injured at work and was immediately fired from her job, according to the suit.
Cochran-Jurin claims she was harassed by the defendant, which willfully, maliciously and unlawfully terminated her due to her injury and prior to her filing a Worker's Compensation claim.
The defendant refused to provide Cochran-Jurin with an accommodation of modified duty, according to the suit.
Cochran-Jurin claims the defendant violated the West Virginia Human Rights Act and caused her to suffer lost wages and benefits.
Cochran-Jurin is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by D. Adrian Hoosier II of the Hoosier Law Firm PLLC.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
