CHARLESTON - A man is suing Thomas Memorial Hospital after he claims it is responsible for his family member's death.
Herbert J. Thomas Memorial Hospital Association is doing business as Thomas Memorial Hospital.
Greenbrier Emergency Services Inc. was also named as a defendant in the suit.
On Nov. 5, 2012, Bevin Kiser became a patient of the defendants and during that time, the defendants were negligent in their care and treatment of her, according to a complaint filed Nov. 19 in Kanawha Circuit Court.
Geffrey Kiser claims the defendants failed to recognize the seriousness of Bevin Kiser's suicidal ideation, failed to make appropriate psychiatric consults and/or failed to admit her to the hospital for further observation and testing.
As a direct and proximate result of the negligence, carelessness, recklessness and marked deviation from the normal standard of care, Bevin Kiser was grievously injured in and about her body; was forced to endure mental and physical pain and suffering; and was injured to a disabling extent in her body, mental and emotional functions, according to the suit.
Geffrey Kiser says Bevin Kiser died on Nov. 9, 2012.
As a further direct and proximate result of the defendants' negligence, Geffrey Kiser incurred funeral and burial costs for Bevin Kiser and suffered great mental pain and anguish; loss of services, society, guidance and companionship of the deceased; and financial and pecuniary losses, according to the suit.
Geffrey Kiser is seeking compensatory and punitive damages. He is being represented by William S. Druckman and Madonna C. Estep of the Law Offices of Druckman & Estep.
The case has been assigned to Circuit Judge Tod J. Kaufman.
