CHARLESTON - A couple are suing American Honda Motor Co. Inc. after they claim their vehicle is defective.
On Dec. 28, Jerald B. Burns and Deborah J. Burns purchased a new 2013 Honda CRV for a total purchase price of $31,065, according to a complaint filed Nov. 21 in Kanawha Circuit Court.
The Burnses claim after purchasing the vehicle they began to experience serious non-conformities with the vehicle, including a no-start condition.
As a result of the ineffective repair attempts for the non-conformities, the vehicle is rendered substantially impaired in value, unable to be utilized for its intended purposes and is worthless to the Burnses, according to the suit.
The Burnses claim the non-conformities violate the express written warranties issued to them by the defendant.
The defendant failed to repair the non-conformities in a reasonable number of attempts and reasonable amount of time by the defendant's authorized repair facilities, according to the suit.
The Burnses are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Christina Gill Roseman.
The case has been assigned to Circuit Judge Jennifer Bailey.
