Mining operations have harmed well water, Wyoming Co. couple say

PINEVILLE - Simon residents are suing after their property was allegedly affected by mining operations.

Gary Huff and Zola Huff filed a lawsuit in the Circuit Court of Wyoming County against Dynamic Energy Inc., Bluestone Coal Corp. and Mechel Bluestone Inc.

According to the complaint, the plaintiffs live in Simon, and in the late 2000's the defendants began mining operations adjacent to the plaintiffs' residence.

The plaintiffs say as a result of the defendants' activities, their well water has become unfit for human consumption. In addition, the defendants have trespassed on the plaintiffs' property and dumped refuse onto their property, according to the complaint.

Further, the plaintiffs state that as a result of the defendants' actions, the plaintiffs' property has decreased in value.

The plaintiffs are seeking to prevent further trespass, actual damages for the loss of value to their property, damages for loss of enjoyment, emotional stress and mental anguish, damages for intentional infliction of emotional distress and punitive damages. They are being represented in the case by attorney David G. Thompson.
