Woman says she was hit with vacuum at Mountaineer Casino

NEW CUMBERLAND - An Aliquippa, Pa., resident is suing a casino and resort, claiming she was hit with a vacuum and seriously injured.

Loretta Boyd filed a lawsuit Nov. 21 in the Circuit Court of Hancock County against Mountaineer Park Inc., doing business as Mountaineer Casino, Racetrack & Resort, and MTR Gaming Group Inc., citing respondeat superior.

According to the complaint, on Nov. 28, 2011, Boyd sustained serious injury when an employee of the defendant swung and struck the plaintiff with a vacuum cleaner while she was lawfully on the defendant's premises.

The plaintiff states the defendant failed to observe the location of the plaintiff, failed to move the vacuum safely, failed to control the vacuum, failed to cordon off the area and failed to avoid an accident and the employee failed to keep a proper lookout.

Boyd is seeking damages in excess of jurisdictional requirements. She is being represented in the case by Thomas D. Hall of Woomer & Hall LLP.
