Man with amputated foot wants dismemberment benefits

WHEELING - An Ohio County resident is suing, claiming he is owed insurance benefits under his death and dismemberment policy.

Stanley Janiszewski filed a lawsuit Nov. 25 in the Circuit Court of Ohio County against The Lincoln National Life Insurance Co.

The complaint states the plaintiff was the insured on an accidental death and dismemberment insurance policy provided by the defendant.

The plaintiff says on Oct. 26, 2011, he was involved in an accident that required his foot to be amputated. The plaintiff filed a claim with the defendant, but the defendant failed to pay and no policy exclusion applies, according to the complaint.

Janiszewski is seeking payment of insurance benefits, plus fees. He is being represented in the case by Bruce M. Clark and Mark A. Kepple of Bailey & Wyant PLLC.
