Nurse says she was wrongfully discharged after Workers' Comp claim

BECKLEY - Pamela R. Chisholm filed suit in the Raleigh County Circuit Court on Nov. 20, alleging wrongful discharge.

Chisholm's lawsuit names Liberty Dialysis Group LLC, Mountain Ridge Dialysis LLC, Alleghany Medical Services P.C. and Fresenius Medical Care Holdings Inc., doing business as Fresenius Medical Care North America, as the defendants.

Chisholm claims she was employed by the defendants as a nurse from December 2006 until November 2011.

Chisholm says she was a good employee who was fired for improper reasons. According to her complaint, Chisholm witnessed various forms of patient misconduct by the defendants. Chisholm allegedly complained to her supervisor to no avail.

In April 2011, Chisholm claims she was loading a box of dialysis solutions when she was injured. Following her injury, Chisholm apparently attempted to receive benefits through the Workers' Compensation system.

Chisholm's claim allegedly closed in October 2011, and shortly thereafter Chisholm attempted to be reinstated to her former position. Chisholm claims that in November 2011, less than 30 days after her claim closed, the defendants fired her.

Chisholm has now brought this suit accusing the defendants of firing her for improper reasons.

Chisholm is seeking damages in the form of back pay, benefits, lost wages and front pay. She is being represented by attorney Todd S. Bailess.
