CHARLESTON - A judgment was ordered earlier this year in a lawsuit against Dr. David J. Patton after a woman allegedly fell from an examination table and suffered injuries.
A trial was held Jan. 14-15 in Kanawha Circuit Judge Louis H. Bloom's courtroom.
The jury deliberated and rendered a unanimous verdict in favor of the defendant, according to the judgment order filed Jan. 16.
On Nov. 1, 2010, Marilyn Schechter was injured when she fell from an examination table while under the care of Dr. David J. Patton, according to a complaint filed Oct. 24, 2011, in Kanawha Circuit Court.
Schechter claimed the defendant failed to properly assess the risks and in allowing her to get off the examination table without any assistance.
The defendant’s actions caused Schechter to incur injuries to her right knee and other parts of her body, according to the suit.
Schechter claimed the defendant’s negligence caused her to sustain severe and permanent injuries; mental anguish; and disfigurement and deformity.
The defendant’s actions also caused Schechter to be hospitalized and incur medical expenses, according to the suit.
Schechter was seeking compensatory damages. She was being represented by Stephen P. Meyer of Meyer, Ford, Glasser & Radman.
The defendant was represented by Joseph L. Amos Jr. and Karen H. Miller.
