CHARLESTON - A couple are suing General Motors LLC after they claim the vehicle they purchased was defective.
On Feb. 1, George H. Wilkinson IV and Julia Wilkinson purchased a new 2013 Chevrolet Cruze from the defendant for the purchase price of $21,755.94, according to a complaint filed Nov. 25 in Kanawha Circuit Court.
The Wilkinsons claim after purchasing the vehicle, they experienced hesitation, stalling, overheating and water leaks in doors.
Despite being afforded multiple opportunities to repair the vehicle, the defendant failed to do so, according to the suit.
The Wilkinsons claim the defendant's failure is a breach of the defendant's contractual and statutory obligations constituting a violation of the Magnuson-Moss Warranty Improvement Act.
General Motors breached its express warranties, breached its implied warranty of merchantability and breached its contract, according to the suit.
The Wilkinsons are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Christina Gill Roseman.
The case has been assigned to Circuit Judge Carrie Webster.
