Woman sues Mardi Gras Casino for alleged injuries

CHARLESTON - A woman is suing Mardi Gras Casino after she claims she was injured while on its property.

On June 26, 2011, Joyce Simpkins was a guest at Mardi Gras Casino as a customer and was exiting the casino when she fell into the street as she stepped on the uneven and broken sidewalk, according to a complaint filed Nov. 13 in Kanawha Circuit Court.

Simpkins claims she sustained injuries to her left ankle as a result of the incident.

The defendant owed Simpkins a duty to exercise ordinary care to keep and maintain the premises of the casino in a reasonably safe condition, according to the suit.

Simpkins claims the defendant was negligent and otherwise breached its duty owed to the plaintiff.

As a direct and proximate result of the defendant's breach of duty, Simpkins endured physical pain and mental suffering; incurred medical expenses; and suffered substantial annoyance, aggravation and inconvenience, according to the suit.

Simpkins is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Donald R. Jarrell.

The case has been assigned to Circuit Judge Jennifer Bailey.
