Logan Co. couple sue Apogee Coal, allege damage to property

LOGAN - Amherstdale residents are suing after their property was allegedly affected by mining operations.

Hebert Trent and Della Trent filed a lawsuit on Nov. 14 in the Circuit Court of Logan against Apogee Coal Co. LLC.

The plaintiffs say they reside in Amherstdale and beginning in 2012 and continuing until April 25, 2013, the defendant conducted blasting operations within close proximity to the plaintiffs' residence.

The blasting activities caused shockwaves and tremors, causing the plaintiffs' residence to vibrate and become damaged, according to the complaint.

The plaintiffs are seeking actual damages, punitive damages, damages for diminished value of property, damages for the cost of repairs, damages for loss of use, fees and costs. They are being represented in the case by attorneys Douglas Witten, Donald C. Wandling and David Wandling of Avis, Witten & Wandling.

A stipulation filed with the complaint states the plaintiffs won't seek more than $74,500, which is $500 less than a threshold for federal jurisdiction.
