CHARLESTON - A couple are suing Paschall Truck Lines Inc. after they claim one of its employees caused a vehicle accident that caused injuries.
Bebee R. Powers and six unknown and unnamed individuals were also named as defendants in the suit.
Robin Dale Hollingsworth and Debbie Kay Hollingsworth
On Nov. 29, 2011, at approximately 5:25 a.m., Robin Dale Hollingsworth was driving a 2007 Freightliner Dump Truck and was traveling south on Corridor G in Alum Creek, according to a complaint filed Nov. 26 in Kanawha Circuit Court.
Hollingsworth claims while he was driving south on Corridor G, Powers, who was operating a Paschall tractor-trailer, attempted an illegal U-turn.
Powers' illegal U-turn caused Hollingsworth to violently collide into the center left-side of Powers' vehicle, according to the suit.
Hollingsworth claims he suffered pain and suffering; mental anguish; medical treatment and expenses; loss of enjoyment of life; and lost wages, financial hardship and loss of future earning capacity.
As a result of the defendants' negligence, Hollingsworth's wife, Debbie Kay Hollingsworth, suffered a loss of consortium, according to the suit.
The plaintiffs are seeking compensatory damages. They are being represented by R. Edison Hill of Hill, Peterson, Carper, Bee & Deitzler PLLC.
The case has been assigned to Circuit Judge Carrie Webster.
