DirecTV dish installer says he fell off roof, sues employer

NEW CUMBERLAND - A man is suing his employer after allegedly sustaining an injury on the job.

Edward P. Sutton, a resident of Weirton, filed a lawsuit Nov. 27 in the Circuit Court of Hancock County against William J. Corella, doing business as B&C Satellites, citing personal injury.

According to the filing, Corella, the sole owner of a DirecTV satellite installation business run out of his Steubenville, Ohio, home, performed installations in both Ohio and West Virginia but was not registered with either Secretary of State.

On Nov. 28, 2011, Sutton says he was installing a dish on a home near New Manchester on behalf of B&C Satellites.

Corella set up a ladder, which he provided, on a wooden deck so that Sutton could access the roof, the suit says. While Sutton was on the ladder adjusting the installed dish, the ladder slid on the deck, which was wet from rain, and Sutton fell to the deck resulting in injury to his left arm and shoulder, the suit says.

The plaintiff alleges that his injuries were a direct result of Corella’s negligent actions, such as failing to provide safety mechanisms for fall protection, failing to provide any safety training, supplying a ladder in dangerous, defective or deficient condition, failing to supervise plaintiff and failing to delay or suspend work until weather conditions abated.

The plaintiff charges that Corella’s conduct was willful, wanton, malicious and reckless and displayed a conscious disregard for the rights and safety of the plaintiff and others.

The plaintiff is demanding a jury trial. He is being represented in the case by Wheeling attorney J. Marty Mazezka of the Law Office of Frankovitch, Anetakis, Colantonio & Simon.
