BECKLEY - A West Virginia resident claims he was subjected to illegal debt collection practices.
Timothy W. Garrison filed a lawsuit Dec. 6 in the Circuit Court of Raleigh County against Westlake Financial Services LLC, doing business as Westlake Financial Services, citing violation the West Virginia Consumer Credit and Protection Act, West Virginia Computer Crime and Abuse Act, Telephone Harassment statute, intentional infliction of emotional distress and common law invasion of privacy.
Garrison says Westlake Financial Services contacted him to collect an outstanding debt.
Westlake Financial Services engaged in violations including attempting to collect a debt by using coercion, engaging in abusive or oppressive conduct and using fraudulent, deceptive or misleading means in attempt to collect a debt, according to the complaint.
Garrison is seeking actual damages, statutory damages, compensatory damages, punitive damages, costs and fees. He is being represented by Ralph C. Young, Christopher B. Frost, Steven R. Broadwater Jr. and Jed R. Nolan of Hamilton, Burgess, Young & Pollard PLLC.
