Mirena lawsuit filed in Wyoming County

PINEVILLE - A Brenton couple are suing a drug manufacturer for damages arising from using Mirena.

Tiffany Steele and Robert Steele filed suit in the Circuit Court of Wyoming County on Dec. 6, against Bayer Healthcare Pharmaceuticals Inc., citing defective manufacturing, defective design, failure to warn, negligence, strict liability, breach of implied warranty, breach of express warranty, negligent misrepresentation, fraudulent misrepresentation and fraud by concealment.

The plaintiffs state they are suing over injuries Tiffany allegedly sustained after using the contraceptive Mirena IUS, which is manufactured, designed, tested and sold by Bayer.

According to the complaint, Tiffany had Mirena inserted on Jan. 31, 2012, and it was discovered on April 16, that Mirena had migrated into her abdominal cavity and required surgical removal.

The plaintiffs contend Mirena was defectively manufactured and defectively designed, causing the plaintiff's injuries. The defendant also knew or should have known the Mirena label did not accurately reflect the risks, according to the complaint.

Tiffany Steele and Robert Steele are seeking an undisclosed amount in damages. They are being represented by Kathy A. Brown of Kathy Brown Law PLLC and Valentina Wheeler of Wheeler Law Firm.
