Bluefield construction company sued

PRINCETON - A Mercer County couple are suing, claiming the construction performed on their home was done in an unprofessional manner.

Ray Price and Sherry Price filed a lawsuit Nov. 8 in the Circuit Court of Mercer County against Lamberts Construction Co. of Bluefield.

According to the complaint, on June 14, 2010, the plaintiffs entered into a contract with the defendant for construction of a bathroom addition, bedroom addition and new driveway.

The plaintiffs say they specifically requested that all construction conform to ADA standards and requested a specific bathroom design.

According to the complaint, the defendant failed to construct the bathroom pursuant to ADA standards or the agreed upon design. The complaint states the defendant willfully and negligently failed to comply with the agreements and performed the work in an unprofessional manner, resulting in numerous construction defects.

The plaintiffs are seeking $50,000 in damages for willful, negligent and intentional infliction of emotional distress, and $40,000 for breach of contract, payment for all costs and labor to repair the construction project, fees and costs. They are being represented in the case by attorney Phillip B. Ball of Smith, Lilly & Ball PLLC.
