Former CAMC Teays Valley employee files FMLA lawsuit

WINFIELD - CAMC Teays Valley Hospital Inc. is being sued by a former nurse after she attempted to take leave under the Family Medical Leave Act.

Hazel Lovejoy filed a lawsuit Dec. 12 in the Circuit Court of Putnam County against CAMC Teays Valley Hospital Inc., citing violations of the Family and Medical Leave Act, intentional infliction of emotional distress and negligent infliction of emotional distress.

The complaint states the plaintiff worked as a nurse for the defendant for 11 years. Lovejoy says she missed work on July 1, July 2 and July 24 to care for her elderly father and on Aug. 23, she requested leave under the Family Medical Leave Act to help care for her father.

On Aug. 27, the defendant terminated the plaintiff for allegedly calling off work on July 24, according to the complaint. The plaintiff contends she was terminated because she requested leave under the Family Medical Leave Act.

Lovejoy is seeking compensatory damages, emotional distress damages, punitive damages, costs, fees and interest. The plaintiff is being represented in the case by attorney Richard W. Walters of Shaffer & Shaffer PLLC.
