Debt collection agency sued for invasion of privacy

WINFIELD -- A woman is suing after receiving harassing phone calls from a debt collector.

Marian Henry filed a lawsuit Dec. 20 in Putnam Circuit Court against GE Capital Retail Bank, citing violation of the West Virginia Consumer Credit and Protection Act, negligence, infliction of emotional distress and invasion of privacy.

According to the complaint, after being contacted by GE Capital, Henry provided the debt collector with her attorney's information. The plaintiff says the debt collector continued to call her home, in direct violation of the West Virginia Consumer Credit and Protection Act.

Henry is seeking damages and cost of litigation. She is being represented in the case by attorney Benjamin Sheridan of Klein and Sheridan LC.
